Terms of service.

These Terms of Service apply to the use of the Vanessa Stirling-Hunter Photography website and to photography services provided by Vanessa Stirling-Hunter Photography.
By making an enquiry, booking a photography service or entering into an agreement with me, you agree to these terms together with any specific terms set out in your quotation, booking confirmation or separate agreement.
Where a specific written agreement has been entered into for a project, the terms of that agreement will apply to that project in the event of any inconsistency with these general Terms of Service.

Throughout these terms, “I”, “me” and “my” refer to Vanessa Stirling-Hunter Photography.
“You” and “your” refer to the person, business or organisation booking or enquiring about my services.
2. Photography services
I provide professional photography services including, but not limited to:
Fashion photography
Beauty photography
E-commerce photography
Campaign photography
Creative and editorial photography
Product photography
Image retouching
Related creative services agreed as part of a project
The exact services, deliverables, fees, usage rights and timescales for each project will be confirmed in the relevant quotation or booking agreement.
3. Quotes and bookings
A quotation will normally set out the proposed services, fees, deliverables and any relevant project requirements.
A booking is confirmed once the agreed booking conditions have been accepted and, where applicable, the required deposit or payment has been received.
A quotation is valid for the period stated on the quotation. If no expiry date is specified, I reserve the right to review the quotation if the project is not confirmed within a reasonable period.
No date is considered fully reserved until the booking has been confirmed.
4. Fees and payment
Fees will be agreed before the photography service takes place and will be confirmed in writing.
Unless otherwise agreed:
Any required deposit or booking payment must be paid by the date specified in the quotation.
The remaining balance must be paid by the agreed due date.
Additional services or expenses requested after the original quotation may incur additional charges.
Any additional charges will be discussed and agreed before they are incurred wherever reasonably possible.
Invoices must be paid by the date stated on the invoice.
If payment is overdue, I may suspend delivery of final images or further services until outstanding amounts have been paid, subject to any rights you may have under applicable law.
5. Additional expenses
Unless specifically included in the agreed fee, additional expenses may include:
Studio hire
Model fees
Hair and makeup
Styling
Travel and accommodation
Equipment hire
Props or set materials
Additional retouching
Additional shoot or editing time
Other third-party production costs
Any significant additional expenses will be discussed and agreed with you before they are incurred where reasonably possible.
6. Changes to a project
Photography projects can involve a number of people, suppliers and production arrangements.
If you request changes to the agreed scope of a project, I will discuss with you whether the change affects the agreed fee, schedule or deliverables.
Changes are not guaranteed to be possible where they affect existing bookings, production arrangements or agreed deadlines.
7. Cancellations and postponements
If you need to cancel or postpone a booking, please contact me as soon as possible.
Cancellation and postponement arrangements, including any applicable fees or treatment of deposits, will depend on the terms agreed for the individual project and the circumstances of the cancellation.
Where third-party costs have already been committed for a project, such as studio, model, hair and makeup or travel costs, you may be responsible for costs that cannot reasonably be recovered.
Any cancellation charges will be reasonable and proportionate to the circumstances.
Nothing in these terms affects any cancellation or other rights you may have under applicable consumer law.
8. Delays and circumstances outside my control
I will make reasonable efforts to complete projects within the agreed timescales.
However, I will not be responsible for delays caused by circumstances reasonably outside my control, including serious illness, accidents, extreme weather, transport disruption, equipment failure, venue or studio issues, power or internet outages, or delays caused by third-party suppliers.
Where such circumstances occur, I will communicate with you as soon as reasonably possible and work with you to agree an appropriate alternative arrangement.
9. Client responsibilities
You are responsible for providing accurate information and any materials reasonably required for the project.
Where applicable, you are responsible for ensuring that:
Products are available and ready for the agreed shoot date
Relevant brand guidelines and creative direction are provided
Necessary permissions are obtained for materials supplied by you
Any required model, location, property or other permissions are arranged where this is your responsibility
Any relevant deadlines or restrictions are communicated in advance
If delays or additional costs result from information, products or materials not being supplied as agreed, the project schedule or fee may need to be adjusted.
10. Creative direction and final images
Photography involves an element of creative judgement, including lighting, composition, colour, styling and editing.
I will work in accordance with the agreed brief and deliverables.
Unless otherwise agreed, the final images supplied will be selected and edited by me in accordance with my professional judgement and the agreed creative direction.
Where specific image selections, edits or revisions have been agreed as part of a project, these will be handled according to the relevant quotation or project agreement.
11. Retouching
Where retouching is included, the level and scope of retouching will be based on the agreed brief.
Additional or extensive retouching requested after delivery may incur an additional fee.
Retouching will be carried out to a professional standard consistent with the agreed creative direction.
12. Delivery of images
Final images will be delivered in the format, resolution and approximate timescale agreed for the project.
Delivery times may vary depending on the size and complexity of the project.
Unless otherwise agreed, delivery of final images is dependent on all outstanding invoices being paid.
I am not responsible for delays caused by third-party file transfer or storage services where I have taken reasonable steps to provide the files correctly.
13. Copyright
Unless otherwise agreed in writing, copyright in photographs created by me remains with me as the photographer.
Copyright in photographs is generally owned by the person or business that creates the work unless ownership is transferred by agreement.
Payment for photography does not automatically transfer copyright ownership.
14. Image usage and licensing
The client will receive the usage rights specifically agreed in the quotation, invoice or separate project agreement.
Unless otherwise agreed in writing, receiving final images does not automatically provide unlimited rights to use, reproduce, resell, sublicense or modify the images for purposes beyond the agreed usage.
If additional usage is required after the original agreement, please contact me to discuss an appropriate additional licence.
Where commercial usage is required, the permitted media, territory, duration and other usage terms should be agreed before the images are used.
15. Portfolio and promotional use
Unless otherwise agreed in writing, I may display photographs created as part of a project in my professional portfolio, website, social media, exhibitions, awards submissions and other promotional materials.
I will take reasonable account of any agreed confidentiality, embargo or non-disclosure requirements.
If a project is subject to confidentiality or a specific restriction on portfolio use, this should be agreed in writing before the project takes place.
16. Client-supplied materials
You remain responsible for ensuring that you have the necessary rights and permissions to provide any photographs, artwork, logos, designs, products or other materials supplied to me for use during a project.
You agree that providing such materials to me does not infringe the rights of any third party.
17. Website content
All photography, images, text, branding, graphics and other original content displayed on this website belong to Vanessa Stirling-Hunter Photography or are used with permission.
You may not copy, reproduce, modify, distribute, sell or commercially use content from this website without prior written permission.
Copyright protection applies automatically to original photography and other qualifying creative works in the UK.
18. Website availability
I aim to keep this website available and up to date, but I do not guarantee that it will always be available, uninterrupted or free from errors.
I may update, change or temporarily suspend parts of the website where reasonably necessary.
19. Liability
I will provide photography services with reasonable care and skill.
Nothing in these terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these terms limits your statutory rights or my responsibility for matters that cannot legally be excluded or limited.
For business clients, any agreed limitations of liability may be set out separately in the relevant project agreement.
20. Personal information
Personal information provided to me is handled in accordance with my Privacy Policy.
My Privacy Policy explains what information I collect, how I use it, who I may share it with and your rights in relation to your personal information.
21. Complaints
If you have any concerns about the service provided, please contact me as soon as possible so that I can try to resolve the issue.
I will consider complaints fairly and aim to resolve them directly wherever possible.
Nothing in these terms prevents you from exercising any legal rights available to you.
22. Governing law
These Terms of Service are governed by the laws of Scotland.
Where you are a consumer, you will also retain any mandatory rights and protections provided by the laws that apply to you.
23. Changes to these terms
I may update these Terms of Service from time to time to reflect changes to my business, services or legal requirements.
The latest version will be published on this website with the date of the latest update shown at the top.
Any changes to the terms of an individual photography project will be agreed separately with the relevant client.
